CHILD CUSTODY SERIES: 20 Factors A Judge Must Consider When Determining Issues of Parental Responsibility and Time-Sharing

The first factor to consider is:
(a) “The demonstrated capacity and disposition of each parent to facilitate and encourage a close and continuing parent-child relationship, to honor the time-sharing schedule, and to be reasonable when changes are required.”

This factor takes into consideration the current behavior of each parent with regards to their willingness to cooperate with the other parent, and whether each parent is encouraging a healthy parent-child relationship for themselves as well as the other parent.

The idea is to encourage healthy and peaceful relationships between separated parents, which is in the best interest of the child.
