Significant changes to alimony laws have gone into effect in Florida, effective July 1, 2023.

One of the new laws regarding how retirement affects alimony is as follows:

The court may reduce or terminate an award of support, maintenance, or alimony upon specific, written findings of fact that the obligor has reached normal retirement age as defined by the Social Security Administration or the customary retirement age for his or her profession and that the obligor has taken demonstrative and measurable efforts or actions to retire or has actually retired. The burden is on the obligor to prove, by a preponderance of the evidence, that his or her retirement reduces his or her ability to pay support, maintenance, or alimony. If the court determines that the obligor’s retirement has reduced or will reduce the obligor’s ability to pay, the burden shifts to the obligee to prove, by a preponderance of the evidence, that the obligor’s support, maintenance, or alimony obligation should not be terminated or reduced.

On April 1st, we celebrated the 30-year anniversary of opening The Law Offices of Gary S. Dolgin!

On this special occasion, we share a special note from Board Certified Expert in Marital and Family Law, Gary S. Dolgin – Attorney at Law:

“April 1st was the 30th anniversary of the opening of my law office.

After gaining courtroom experience as both a prosecutor and public defender, I opened up my solo practice on April 1, 1993 with no clients, no runs and no errors!

I remember being excited when my phone rang for the first time. It was a salesman from the yellow pages.

The late Arnold Levine referred me my first case, a young man charged with driving with a suspended license and a worthless check.

A few weeks later I was referred my first divorce case and seven years later became Board Certified in Marital and Family Law with the help of mentors including the late Joe Hood, Steve Sessums and Fraser Himes.

Thank you to all of my clients for trusting me to help them get through some of the most difficult times in their lives. Thank you to my colleagues, past clients and even some of their ex spouses who continue to refer me cases.

I am honored to have recently handled two matters referred by two different ex-spouses of former clients.

A divorce case can often take months to conclude, therefore temporary court orders may be requested for certain issues such as alimony while the divorce case is pending.

The court may consider adultery or other misconduct of either spouse in determining a proper award of temporary alimony.

The award, however, may not be made simply as punishment for misconduct, but should relate to dissipation of marital assets.

Misconduct may also be a mitigating defense to an award of alimony, which the court in its discretion may choose to consider.

The trial court has equitable jurisdiction to award temporary relief, even in a marriage that is alleged to be bigamous.

A divorce case can often take months to conclude, therefore temporary court orders may be requested for certain issues such as alimony while the divorce case is pending.

When making a case for temporary alimony, evidence of the incomes, standard of living, and expenses of the parties during their marriage must be presented.

Many avenues of documentation of the standard of living are available.

Photographs of the marital residence and its accoutrements show the court the type of living accommodations to which the parties have been accustomed.

Appraisal reports of recent gifts made by the parties to each other or the children can be helpful, as can copies of credit cared records and canceled checks.

Documentation of the parties’ lifestyle by the movant may lead to the imputing of income not acknowledged by the income-earning spouse.

Happy Valentine’s Day and Happy Birthday To Dr. Ann Dolgin who turns 88 years old today!

Today we honor Gary’s sweet and wonderful mother on her special day.

Gary shares a beautiful dedication to his Mom:

“My mother has always been a trail-blazer.

When my brother, and sister and I were in elementary school, she obtained her Doctorate in Education and showed us, at an early age, the importance of hard work and dedication. She temporarily relocated with us to the University of Miami and my Dad visited every other weekend, traveling from Tampa.

She lost her mother at age 14 to cancer and my grandfather, who worked seven days a week in a laundromat, sacrificed to make sure that my uncle and my mother were the first in the family to attend college. My mother passed on the importance of education to her children.

My brother, sister and I all reside in Tampa. My brother is a Ear, Nose and Throat surgeon, and my sister is an Engineer.

My mother was married to my father for 53 years at the time of his death.

At 88, she is still sharp and enjoying her retirement. She is still a world traveler and is going to Morocco in March.

She enjoys her eight wonderful grandchildren and is always ready to share her life experiences and advice with them. She is also thrilled to have became a great grandmother on February 4th.”

Gary Dolgin’s father, the late Dr. David Dolgin would have celebrated his 92nd birthday tomorrow.

He is missed and remembered warmly by the Dolgin family and those friends and patients who loved him.

Gary shares his touching sentiment in loving memory of his father:

“It is so hard to believe that 14 years ago this month my dad Dr. David Dolgin passed away unexpectedly while traveling with my mother on a three week trip thru Vietnam, Cambodia and Thailand.

When he got sick in Bangkok, he called me and asked me to call his office and reschedule his patients. He was still practicing periodontics one day each week at the age of 77. His patients loved him and did not want him to retire.

My dad was Tampa’s first Board Certified Periodontist. His Board Certification inspired me to become a Board Certified Expert In Marital and Family Law as well.

I miss him everyday. I wish we had more time with each other. I am thankful he had the joy of meeting all of his grandchildren, but I wish he could see them now.

He would have been thrilled to be at my son Corey’s wedding last month but his presence was felt during this special occasion. He would have warmly welcomed Melanie into the family.

He and my mother would have been married 67 years this past December.

Today we remember the wonderful husband, father, grandfather and brother that he was.”
