Generally speaking, the length of a marriage bears a direct relationship to the initial decision to award alimony.

It is presumed that:

– a short-term marriage is a marriage having a duration of less than 7 years;

– a moderate-term marriage is a marriage having a duration of greater than 7 years but less than 17 years;

– and a long-term marriage is a marriage having a duration of 17 years or greater.

Permanent alimony may be awarded following a marriage of long duration, if such an award is appropriate upon consideration of the other alimony factors set forth in [F.S. 61.08](2).

Permanent alimony may be awarded following a marriage of moderate duration if such an award is appropriate based upon clear and convincing evidence and after consideration of the factors set forth in [F.S. 61.08](2).

If there are written findings of exceptional circumstances, permanent alimony may be awarded following a marriage of short duration.

In awarding alimony, the Court may not factor in speculative post-dissolution savings based upon how frugal the parties were during the marriage.

Any accumulation of marital assets due to the parties being frugal and saving during the marriage is taken into consideration by equitable distribution.

“When I met Supreme Court Justice Sandra Day O’Conner at Emory University in 1984, she invited me to visit her at the Supreme Court.

I accepted the invitation and went to visit her the following summer, where I had the opportunity to interview her.

It was a wonderful honor to interview her, and I greatly appreciate that she took the time to talk with me.”

“Family lawyers and Judges see a lot of unhappy and sad ‘stuff’-custody battles, domestic violence, etc.

But today is a Happy Adoption Day!

I was honored to represent two wonderful grandparents adopt their granddaughter.

They stepped up to the plate many years ago when we obtained a temporary custody order for them.

Today they made it official- they are forever parents to a wonderful young girl, who told the Judge that she wanted the couple who have raised her as long as she could remember to be her mom and dad.”

Although the Court may look to the parties’ standard of living in determining the amount of an alimony award, an evaluation of income and ability to pay is also required.

In Thilem v. Thilem, 662 So.2d 1314 (Fla. 3d DCA 1995), the court reversed an award of permanent alimony based on the parties’ standard of living, noting that they had lived beyond their means, supported in part by loans from relatives.

Conversely, when the income to be earned by the spouse who previously stayed at home would not be sufficient to pay another person to take over that spouse’s childcare duties, that spouse should not be required to become employed.

If a parent or other person files a petition to relocate a child, the other parent or other people entitled to access to or time-sharing with the child may object to the relocation.

An answer objecting to the proposed relocation must be verified and include the specific factual basis supporting the reasons for seeking prohibition of the relocation.

This must also include a statement of the amount of participation or involvement the objecting party currently has or has had in the life of the child.
